1. Legal Entity Notice

Beach Day Setup is a doing business as (DBA) name of Sdchecklist LLC, a California limited liability company. All services, bookings, and payments are legally under Sdchecklist LLC.

2. Services Provided

Beach Day Setup provides beachside services including the setup and delivery of canopies, chairs, towels, games, coolers, and other recreational equipment.

All services are provided “as is” and are used at your own risk.

3. Customer Responsibilities

By booking, the customer agrees that:

They are responsible for ensuring compliance with all local city and beach regulations (alcohol, noise, fires, permits, curfews, etc.).
Beach Day Setup is a third-party rental and setup service only and is not responsible for any citations, fines, or shutdowns issued by local authorities.
The customer is responsible for the actions and safety of all guests during the event.

4. Equipment Use & Liability

All equipment must be treated with care and returned in the same condition it was delivered.

Customers are financially responsible for any missing, stolen, or damaged equipment.
The card on file may be automatically charged for repair, replacement, or cleaning fees.

5. Booking & Cancellation Policy

Full Refund: Cancellations made at least 24 hours before the reservation start time.
50% Refund: Same-day cancellations.
No Refund: No-shows or cancellations after the event start time.

6. Weather-Related Cancellations

If unsafe weather conditions arise, you may cancel for a full refund if done 24+ hours prior.
Same-day weather cancellations are eligible for rescheduling or a 50% refund, at the company’s discretion.
Beach Day Setup reserves the right to cancel events for safety reasons (lightning, high winds, unsafe surf, closures). If so, a full refund or reschedule will be provided.

7. Indemnification

The customer agrees to indemnify and hold harmless Sdchecklist LLC (DBA Beach Day Setup), its employees, contractors, and affiliates from any claims, damages, injuries, fines, or losses arising out of participation in services.

8. Waiver of Liability

By booking, you voluntarily assume all risks associated with beach activities, including:

Injuries to you or your guests
Property loss or theft
Damages caused by improper equipment use

Sdchecklist LLC (DBA Beach Day Setup) is not liable for any damages, citations, or claims arising from your use of our services.

9. Right to Cancel

Beach Day Setup may cancel your booking due to:

Unsafe weather conditions
Equipment failure
Staffing shortages
City or beach restrictions
Other unforeseen circumstances

If this occurs, you will receive a full refund or the option to reschedule.

10. Limitations on Liability & Warranties

Our services and website are provided “as is” and without warranties of any kind.

We are not liable for:

Technical issues or downtime
Errors in service availability
Third-party products or services linked through our site

To the fullest extent allowed by law, our liability is limited to the amount you paid for the service.

11. Disputes

This agreement is governed by the laws of San Diego, California.

Arbitration: You agree to resolve disputes through binding arbitration under the rules of the American Arbitration Association, unless prohibited by law.
Court Proceedings: If arbitration is not allowed, disputes must be filed in a court with jurisdiction in San Diego, CA.
Improper Legal Action: If you file a claim in violation of this section and refuse to withdraw after notice, we may seek dismissal and reimbursement of reasonable attorney fees and up to $1,000 in costs.

12. Force Majeure

We are not responsible for delays or cancellations caused by circumstances beyond our control, including natural disasters, acts of government, labor disputes, or public safety concerns.
